Before you begin
Thaya is a general wellness and nutrition-tracking app. Its food recognition and nutrition values are estimates. By creating an account, checking the acceptance box, purchasing a subscription, or using Thaya, you agree to these Terms and our Privacy Policy.
1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and the operator of Thaya ("Thaya," "we," "us," or "our") governing your access to and use of the Thaya mobile application and related services (the "Service"). Our Privacy Policy is incorporated by reference.
If you do not agree, do not create an account, purchase a plan, or use the Service. If you use Thaya for an organization, you confirm you have authority to bind that organization.
2. What Thaya provides
Thaya provides tools for meal logging, AI-assisted food recognition, estimated calories and nutrients, personalized goals, optional Apple Health or Health Connect sync, water and fasting tracking, reminders, progress tracking, and subscription-based features.
Some features require an account, internet connection, supported device, camera/photo permission, notification permission, health permission, or active subscription. Optional permissions are requested when relevant; declining them may disable only the related feature.
Thaya may provide recommendations or targets calculated from information you enter. These are automated general-wellness outputs and may not reflect your complete circumstances.
3. Eligibility and accounts
You must be at least 13 to use Thaya. If you are under the legal age of majority where you live, a parent or legal guardian must review and accept these Terms for you and supervise your use. Thaya is not intended for children under 13.
- Provide accurate, current information and update it when needed.
- Keep your password and device secure and do not share your account.
- Notify us promptly at contact@limaz.co if you suspect unauthorized access.
- You are responsible for activity under your account unless applicable law says otherwise.
- One person may not operate multiple accounts to evade plan limits, scan quotas, enforcement, or trial eligibility.
4. License, ownership, and your content
License to you
Subject to these Terms and store rules, Thaya grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Service on devices you own or control for personal, non-commercial use. No ownership rights are transferred to you.
Thaya materials
The Service, brand, software, interface, designs, databases, text, graphics, models, and other materials — excluding content you provide — are owned by or licensed to Thaya and protected by applicable intellectual-property laws. You may not copy, modify, distribute, sell, lease, or create derivative works except as the law expressly permits.
Your content
You keep ownership of meal photos, progress photos, text, corrections, and other content you provide. You grant Thaya a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, format, and process that content only as needed to provide, secure, operate, and improve the Service as described in the Privacy Policy. This license ends when the content is deleted, except for protected backups, legal retention, and genuinely de-identified scan-quality data that no longer identifies you.
You confirm you have the rights needed to upload your content and that it does not violate another person’s privacy, intellectual-property, or other rights. Avoid uploading faces, documents, or unrelated sensitive information.
Feedback
If you send suggestions or feedback, you allow us to use it without restriction or payment, but we are not required to use it.
5. Acceptable use
You may not, and may not help anyone else to:
- use the Service unlawfully, fraudulently, or to harm another person;
- upload illegal, infringing, malicious, sexually exploitative, or privacy-invasive material;
- bypass or manipulate scan quotas, subscription checks, authentication, security, or technical limits;
- reverse engineer, decompile, disassemble, scrape, copy, or discover source code or models, except to the limited extent such a restriction is prohibited by law;
- use bots, automated requests, or abnormal traffic that disrupts or burdens the Service;
- probe vulnerabilities, introduce malware, access another account, or interfere with systems or networks;
- resell, sublicense, commercially exploit, or use Thaya outputs to build a competing dataset, model, or service without written permission;
- present Thaya estimates as clinical, diagnostic, or professionally verified information.
We may investigate suspected misuse and apply reasonable limits or suspend access to protect users and the Service.
6. Health, nutrition, and AI disclaimer
Thaya is for general wellness and informational use only. It is not a medical device and does not provide medical advice, diagnosis, treatment, or emergency services.
Food identification, portion size, calories, macronutrients, fiber, sugar, sodium, energy expenditure, targets, and progress projections are estimates based on images, databases, user input, and automated assumptions. Restaurant meals, homemade dishes, mixed plates, and regional recipes vary. AI can be incomplete, inaccurate, or misleading.
- Review and correct every result before relying on it.
- Do not use Thaya as the sole basis for decisions about allergies, pregnancy, eating disorders, medication, diabetes, kidney disease, or any medical or therapeutic diet.
- Consult a physician, registered dietitian, or other qualified professional before making health decisions.
- Do not delay or disregard professional advice because of Thaya.
- For a medical emergency, contact your local emergency service immediately.
You assume responsibility for your food choices, activity, and use of estimates. Health data imported from Apple Health or Health Connect may also be incomplete or delayed.
7. Paid plans, trials, and billing
Purchase
Thaya Pro and other paid features may be offered as auto-renewing subscriptions through Apple App Store or Google Play. The exact product, benefits, billing period, trial (if any), localized price, taxes, and currency are shown on the purchase screen before you confirm. Store terms and your store account govern payment processing.
Automatic renewal
Unless cancelled, your subscription renews automatically for the period shown at purchase. Your store account will be charged at the then-disclosed price within the time window specified by Apple or Google, generally near the end of the current period. To avoid renewal, cancel in your App Store or Google Play subscription settings at least 24 hours before the end of the current billing period.
Trials and promotions
Trial eligibility, length, and conversion price are shown before purchase and may be limited to eligible users. Unless cancelled before the trial ends, the trial converts to the paid subscription displayed at checkout. Where store rules allow, unused trial time may be forfeited when you purchase a subscription. Promotions may have additional disclosed conditions.
Managing, cancelling, and restoring
Manage or cancel through the same Apple or Google account used to purchase. Cancellation stops future renewals and ordinarily leaves access active through the paid period. Deleting the app or your Thaya account does not automatically cancel a subscription. You can use Restore Purchases in Thaya where available.
Price changes and refunds
Apple or Google will provide any notice or consent process required for a subscription price change. Refunds, charge disputes, billing errors, and store taxes are handled under the policy of the store where you purchased, except where applicable law gives you additional rights. Thaya cannot directly issue a refund for a transaction controlled by an app store.
8. Apple and Google terms
Your use of the app is also subject to the applicable store’s terms. If these Terms conflict with mandatory store terms, the store terms control to that extent.
Apple App Store
For an iOS download, these Terms are between you and Thaya, not Apple. Apple is not responsible for the app or its content, maintenance, support, warranties, claims, or intellectual-property disputes. Your license is limited to Apple-branded products you own or control as permitted by the Usage Rules, including access through Family Sharing or volume purchasing where applicable. You represent that you are not in a country subject to a United States government embargo and are not on a prohibited or restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Apple’s Standard Licensed Application End User License Agreement also applies where required.
Google Play
For an Android download, Google is not responsible for the app or its support. Your use is subject to the Google Play Terms of Service and applicable purchase, subscription, and refund policies.
9. Third-party services, updates, and availability
Thaya depends on services operated by others, including Apple, Google, Supabase, Firebase, RevenueCat, and AI providers. Their availability and terms can affect features. We are not responsible for third-party services outside our reasonable control.
We may add, improve, limit, or discontinue features; adjust reasonable usage limits; or release updates for security, compatibility, legal, or product reasons. Updates may be required to keep using the Service. We do not promise that every feature will always be available, error-free, or compatible with every device or region.
10. Account deletion, suspension, and termination
You may stop using Thaya at any time and delete your account through Profile → Delete account. Account deletion is described in the Privacy Policy. Remember to cancel an active subscription separately.
We may limit, suspend, or terminate access if you materially or repeatedly violate these Terms, create risk or legal exposure, fail to pay for paid access, or if required to protect the Service or comply with law. Where appropriate and legally required, we will provide notice and an opportunity to address the issue.
On termination, your license ends. Provisions that by their nature should survive — including ownership, disclaimers, limitations, dispute terms, and accrued payment obligations — remain effective.
11. Warranties and limitation of liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Thaya disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not warrant that nutrition estimates, AI results, goals, forecasts, or health data are accurate or suitable for you.
To the maximum extent permitted by law, Thaya and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, goodwill, or opportunity; or personal decisions made in reliance on estimates, even if advised of the possibility.
Where liability cannot be excluded, Thaya’s aggregate liability for claims relating to the Service will not exceed the greater of (a) the amount you paid to Thaya through the app stores in the 12 months before the event giving rise to the claim or (b) USD 50, unless applicable law requires a different amount.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.
12. Governing law and disputes
Before filing a formal claim, please contact contact@limaz.co and describe the issue so we can try to resolve it informally.
These Terms are governed by the laws applicable where the Thaya operator is established, without regard to conflict-of-law rules. Courts with jurisdiction over that operator will hear disputes, except that consumers may bring a claim in their place of residence where mandatory consumer law allows. Your non-waivable rights under local law remain unaffected.
The United Nations Convention on Contracts for the International Sale of Goods does not apply. Nothing prevents either party from seeking urgent injunctive relief for security or intellectual-property misuse.
13. Changes to these Terms
We may update these Terms for legal, security, provider, or product changes. We will post the new version and effective date and, for material changes, provide reasonable notice in the app or ask you to accept again when required. If you do not agree to an update, stop using the Service before it takes effect and cancel any subscription separately.
14. General terms
These Terms and the Privacy Policy are the entire agreement about the Service, except for terms shown at purchase or required by an app store. If a provision is unenforceable, it will be modified only as much as necessary and the rest remains effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, or transfer of the Service. Headings are for convenience only.
